McCoy 2008 Campaign Button Contest (“Contest”)

OFFICIAL RULES

NO PURCHASE NECESSARY TO PARTICIPATE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN QUEBEC AND WHERE PROHIBITED.

TO ENTER: Between May 15, 2008 and August 15, 2008 create a campaign button design with a “Get Out The Vote” theme. You may submit your entry starting at 12:00 AM ET on May 15, 2008, by going to www.24-7designheaven.com and following the on-screen directions to submit your entry. Entries must be received by 11:59 PM ET on August 15, 2008. Limit one entry per person (“Entrant”). All entries become the property of S.D. Warren Company D/B/A Sappi Fine Paper North America (“Sponsor”). Entries must be original. Entries may not include or infringe any intellectual property of third parties, including copyrighted material or trademarks, and must not be libelous, obscene or indecent, all as determined by Sponsor in its sole discretion.

ELIGIBILITY: The Contest is only open to legal residents of the 50 United States, District of Columbia or Canada (excluding Quebec), thirteen years of age or older at time of entry. Employees of Sponsor, its affiliates, subsidiaries, distributors, sales representatives, advertising, promotion and judging agencies and all other service agencies involved with this Contest, and members of the immediate families (parent, child, sibling and spouse) or households of any of the above are not eligible.

JUDGING: Judging and voting will only be conducted online. All qualified entries will be posted on the Sponsor’s website, www.24-7designheaven.com on the date submitted. Judging and voting will begin at 12:00 AM ET on May 15, 2008 by the design community. Persons who wish to vote, including Entrants, should follow the on-screen directions to vote for their favorite entry or entries. Votes must be received by 11:59 PM ET on August 15, 2008. Limit one vote per person per button design. Automated methods of voting are prohibited. The top ten (10) entries will be the Grand Prize winners.

PRIZES: Ten (10) Grand Prizes: Each Grand Prize winner will receive a $100.00 Apple Gift Card and one hundred (100) campaign buttons imprinted with the winner’s design. Approximate retail value (“ARV”): $110.00 each. One thousand (1,000) First Responder Prizes: The first (1,000) Entrants in the contest will each receive a $10.00 iTunes Gift Card. ARV: $10.00 each. Total ARV of all Contest prizes: $11,100.00. Limit one prize per person. Prizes are not transferable. No cash redemptions, other than as set forth herein. No prize substitutions permitted, except by Sponsor, who may substitute a prize of equal or greater value if advertised prize becomes unavailable.

GENERAL: Limit one prize per person/household. All winners will be notified by e-mail and the gift card prizes will be delivered concurrently to the e-mail address provided by the winning Entrants. If notification or any prize is returned as undeliverable, the status and prize will be forfeited. By entering this Contest, all Entrants agree that neither Sponsor, its affiliated or subsidiary companies, nor their respective directors, officers, employees or agencies will have any liability whatsoever for any injuries, losses or damages of any kind caused by or in connection with any prize or resulting from participation in this Contest, or from acceptance, possession or use of any prize or participation in any prize-related activity or use by Sponsor of the entry in any manner. Winners further acknowledge that the above parties are in no manner responsible or liable for, and specifically disclaim any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose. If, for any reason, this Contest cannot be conducted as planned by any cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend this Contest and determine winners from entries and votes received prior to such action, or as otherwise deemed fair and equitable by Sponsor. Winners are solely responsible for any local, state, or federal taxes on prizes. Void where prohibited. Promotion is subject to all applicable federal, state, local and provincial/territorial laws and regulations. Each Entrant hereby warrants that its entry is original to Entrant, is in all respects copyrightable, and will not violate any patent, copyright, trade secret or other property right of any other party. By entering this Contest, Entrants agree that all disputes, issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with this Contest, will be governed by, and construed in accordance with, the internal laws (and not the choice of law rules) of The Commonwealth of Massachusetts. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring Entrants who do not comply with these Official Rules. Furthermore, by entering this Contest, Entrants consent to the jurisdiction and venue of the federal, state and local courts located in Boston, MA.

OWNERSHIP OF ENTRIES: Upon submission of an entry, Entrant agrees that the Sponsor owns, or shall own, all right, title and interest in and to the entry. To the extent that any right, title or interest to any entry may not vest in Sponsor by operation of law or otherwise, then all right, title and interest to that entry is hereby irrevocably assigned to Sponsor or, if not yet assignable, will be assigned to Sponsor by Entrant. Entrant (or the parent or legal guardian if Entrant is a minor) hereby agrees that the Sponsor may use the entry, Entrant’s name, photograph, likeness and/or prize information for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited. Furthermore, Entrant agrees that Sponsor, and its agents on behalf of Sponsor, has the right to publish, use, adapt, edit and/or modify the entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without time limitation and without further consideration to the Entrant.

LIMITATIONS OF LIABILITY: Multiple entries, including multiple entries by the same Entrant using different e-mail addresses or entries generated by a script, macro or use of automated, robotic, repetitive or similar devices, will be invalid. In the event of a dispute regarding the identity of an Entrant, such entry will be deemed to be made by the authorized account holder of the e mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address, provided that person meets all eligibility criteria set forth in these Official Rules. Sponsor assumes no responsibility for computer system, hardware, software or program malfunctions or for other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature, or for lost, late, incomplete, damaged, garbled or misdirected entries. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by website users or by any of the equipment or programming associated with or utilized in this Contest, any theft or destruction or unauthorized access to, or tampering with or hacking of the website, or by any technical or human error, which may occur in the transmission, receipt or processing of the entries. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Contest or the website, may be acting in violation of the terms of the website or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage the website or undermine the legitimate operation of this Contest is unlawful and subject to legal action by Sponsor or its agents.

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ENTRANT’S ACCESS TO AND USE OF THE CONTEST WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE. Requests must be received by October 31, 2008. Canadian residents may omit return postage. Winners list will be sent after all winners have been verified.
